Автором рассмотрены правовые основы противодействия генетической дискриминации в контексте ведущего регионального интеграционного объединения на Африканском континенте, исследованы ключевые наднациональные механизмы защиты от дискриминации. Особое внимание в исследовании уделено комплексному обзору опыта государств — членов Африканского Союза в части противодействия дискриминационным и стигматизирующим практикам. Опыт Малави, Южно-Африканской Республики, Судана демонстрирует не только приверженность концептуальным подходам в отношении запрета на генетическую дискриминацию, сложившимся на глобальном уровне, но и возможности реализации принципа недискриминации в рассматриваемой сфере в национальном разрезе. Автором сформулированы тенденции развития наднационального и национального регулирования в области противодействия генетической дискриминации на Африканском континенте, предложена рецепция лучших практик для совершенствования релевантной регуляторики в Российской Федерации и интеграционных объединениях с ее участием.</p></abstract><trans-abstract xml:lang="en"><p>The paper is devoted to a detailed analysis of the implementation of the principle of non-discrimination based on genetic status within the framework of the African Union, as well as its member states. The author examines the legal framework for countering genetic discrimination in the context of the leading regional integration association on the African continent, and examines key supranational mechanisms for protection against discrimination. The study focuses on a comprehensive review of the African Union member states experience in countering discriminatory and stigmatizing practices. The case study of Malawi, the Republic of South Africa, and the Sudan demonstrates not only a commitment to conceptual approaches regarding the prohibition of genetic discrimination that have developed at the global level, but also the possibility of implementing the principle of non-discrimination in this area from a national perspective.
