Administrative Law in France and in Russia. Common trends through the prism of different development paths

Abstract

In early 2014, French and Russian scholars discussed the topical issues of development of administrative law in France and Russia at the International Conference organized by the Centre of Public Law named after Michel de L'hospital of the University of Auvergne (Clermont-Ferrand) and the Association of Comitas Gentium France-Russia (Comitas Gentium France-Russie). French administrative law experts proposed to discuss the following topics: the place and role of the public service in administrative law of France (Gilles Guglielmi); the current state of the judicial dualism in France (Dominique Turpin); administrative activities and legal dualism in France (Benoit Plessix); liability without fault and socialization of risks in France (Maryse Deguergue); outsourcing and its limits in French public institutions (Pierre Esplugas); administrative transparency and the development of participatory democracy (O. Lavail); fault in the administrative law of France (Benoit Delaunay); public authorities subordination to competition law (Aurélien Antoine); the role and nature of independent public (government) bodies Involved in the regulation of the economy (Pascale Idoux); protection of fundamental freedoms by an administrative court (Marie-Elisabeth Baudoin). Russian scholars made reports on administrative justice in Russia (Y. N. Starilov); the development of the law on administrative responsibility in Russia (K.A. Kononov); "urgent procedures" in Russian law (M.A. Filatova); the principle of transparency in Russia (Karin Bechet-Golovko); public authorities subordination to competition law Rules in Russia (S.V. Vasilyeva); public law regulation of the economy in Russia: institutional evolution (Elvira Talapina); delineation of administrative and criminal liability under Russian law (L.V.Golovko). The published materials highlight the major problems of these topics.
